The draft Geographical Indications of Goods (Registration and Protection) (Amendment) Rules, 2023

The Ministry of Commerce and Industry (MoCI) published the draft Geographical Indications of Goods (Registration and Protection) (Amendment) Rules, 2023 in the Gazette of India on October 20, inviting objections and suggestions from the relevant stakeholders. The draft also calls for comments from stakeholders within 30 days of its publication in the Gazette.

The Department for Promotion of Industry and Internal Trade (DPIIT) and the Controller General of Patent, Designs and Trademark (CGPDTM) announced it on their website on October 27, 2023 i.e. after a week of its original publication. Objections or suggestions, if any, may be addressed to the Secretary, Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry, Government of India, Vanijya Bhawan, New Delhi- 110011 or by e-mail at anurag.saxena@nic.in

While we are reviewing the document, the good news for the stakeholders is that the draft Rules proposes reduction in the fee for filing an application for a GI from Rs. 5000 to Rs. 1000.

GIs are essential for preserving cultural heritage, boosting various sectors of the economy, ensuring quality and providing market access for local products.

The current GIs in India are not only contributing to the economic development of specific regions in the country but also playing a vital role in enhancing India’s image in the global market.
